What information we collect.
We may collect and use Personal Information and Sensitive Information about you and other individuals connected with you or your organisation, including directors, officers, shareholders, beneficial owners, controllers, authorised representatives and other associated persons.
This may include identity and contact details, identification documents, ownership and control information, political association membership, health, screening information, other information relevant to the engagement and our compliance obligations.
We will only collect personal information that is reasonably necessary to carry out the Services, for our functions and activities, including fulfilling our compliance obligations under applicable laws, including the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth)(AML/CTF Act) and related legislative regime (AML/CTF Regime). We may require your Tax File Number (TFN) in order to carry out Services. Providing your TFN is voluntary, however without it, we may be unable to perform the Services.
Why we need to collect your information.
Where applicable, we collect this information so that we can manage the risks of money laundering, terrorism financing and other financial crime if we provide a Designated Service to you as defined by the AML/CTF Act and applicable amendments and updates.
We use your personal information in connection with our engagement, including client onboarding, due diligence, carrying out the Services, and variations or updates in the scope of services we provide to you, as we must comply with our professional obligations and applicable laws, including the Tax Agents Services Act 2009 (Cth), privacy requirements, and AML/CTF Regime.
How we collect your information.
We will generally collect your personal information directly from you, which can include using a third party identity verification service to collect personal information on our behalf. We may also collect personal information from other professional advisors, government sources, or public sources, such as registers or the internet.
If you provide us with personal information about another person, you confirm that you are authorised to do so and that you have taken any necessary steps to notify that person, and obtain any required consents, permissions or other rights, so that we may collect, use and disclose that information for the purposes described above. You must also let them know about this notice.
Where your information is stored or shared.
As part of our operations, personal information may be stored or processed outside Australia, including through Microsoft 365 collaboration environments, Microsoft 365, Xero, Hubdoc, RabbitSign, Zoom, Tally*, JotForm, Sharepoint, Waive, Canva, and SodaPDF, as well as third-parties to assist with AML/CTF Regime obligations including identity verification and storage (including Annature), our other systems, and other approved third-party service providers.
We implement safeguards and privacy controls in accordance with our privacy and data protection requirements. We may also be required to share your personal information with AUSTRAC to meet our obligations under the AML/CTF Regime.
What happens if we cannot collect your information.
If you do not provide requested information, we may be unable to commence or continue acting for you, or we may need to place restrictions on the scope of services we can provide.
